So I've been working on my TCG  'Prophecy' since 2009.  Now looking for online sources with people interested in beta-testing I find an online card game called HEX which is EXACTLY like it.   I even have cards called hex cards and we both include bosses and blood types.

I don't want to violate copyright laws and don't want a replica of my game out there either.  Does anyone know exactly how similar games can be to each other legally?  Because I would still like this game to be published once my art is done.

It's funny 'cause HEX is currently in a lawsuit against Wizards of the Coast for using elements from their intellectual property (Magic the Gathering). The games are actually really similar in many ways, even if the point of HEX was completely different (they aimed to create an MMOTCG which is based on character creation, customization and evolving simultaneously your avatar and the deck).

It really depends on what are the similarities. Is it just the names? If so, I don't think that it can be such a big problem, but if you feel like it is, just rename the mechanism you have problem with. If it is a carbon copy (which means that they are played in the same style and 90-95% is the same of the two games), then I suggest you to re-think the game's basics.

I thought about that afterwards and you're right.  Names can be changed and stuff game-play tweaked a tad bit to still keep it legitimate.  But in all honesty, who doesn't Wizards of the Coast want to sue?  The got down yugioh's throat soon after konami started to print for them.

MMOTCG, I'm surprised hearthstone didn't sue them tbh.
